Agreement to Terms

By downloading, installing, or using Watchtowers (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Watchtowers ("we", "our", or "us") governing your use of the App.

License Grant

Subject to your compliance with these Terms and payment of the applicable license fee, we grant you a limited, non-exclusive, non-transferable, revocable license to:

  • Install and use the App on any Mac computers that you own or control for your personal or internal business use
  • Use the App to monitor health check endpoints that you are authorized to access
  • Receive and install updates to the App as they become available

This license does not permit you to distribute, sublicense, lease, rent, or otherwise transfer the App or your license to any third party.

Free Trial

We offer a 7-day free trial period. During the trial, you have access to the full functionality of the App. At the end of the trial period, you must purchase a license to continue using the App.

No credit card is required to start a trial. Your data and configuration will be preserved after the trial ends, whether or not you purchase a license.

Payment and Refunds

The App is available as a one-time purchase. Payment is processed securely through Paddle, our authorized payment processor. By making a purchase, you also agree to Paddle's Terms of Service.

All prices are displayed in USD and may be subject to applicable taxes, which are calculated and collected by Paddle based on your location.

We offer a 30-day money-back guarantee. If you are not satisfied with the App within 30 days of purchase, contact us at support@watchtowers.app for a full refund.

Updates and Upgrades

Your purchase includes all updates and bug fixes for the current major version of the App. We may release major version upgrades in the future that include significant new features.

Major version upgrades may be offered as a separate paid upgrade at a discounted rate for existing customers. You are never required to upgrade and may continue using your current licensed version indefinitely.

Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the App to monitor endpoints that you are not authorized to access
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Remove, alter, or obscure any proprietary notices or labels on the App
  • Use the App in any manner that could damage, disable, overburden, or impair any server or network connected to your monitored endpoints
  • Redistribute, sell, or sublicense the App or any part thereof

Intellectual Property

The App, including its design, code, graphics, logos, and documentation, is the property of Watchtowers and is protected by copyright, trademark, and other intellectual property laws.

Your purchase of a license does not transfer any ownership rights in the App. All rights not expressly granted in these Terms are reserved by us.

Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

All data generated by the App is stored locally on your device. We do not have access to, and are not responsible for, your locally stored data. You are solely responsible for maintaining backups of your data.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The App is a monitoring tool and should not be relied upon as the sole means of detecting service outages or failures. We recommend using multiple monitoring solutions for critical infrastructure.

Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Watchtowers be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or in connection with your use of the App.

Our total liability for any claims arising from or related to these Terms or the App shall not exceed the amount you paid for the App license.

Termination

We may terminate or suspend your license immediately, without prior notice, if you breach any provision of these Terms. Upon termination, your right to use the App will immediately cease.

You may terminate these Terms at any time by uninstalling the App and ceasing all use. Termination does not entitle you to a refund except as provided in the Refunds section above.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of competent jurisdiction.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
